[5 March 2023] ICASA has undertaken further consultations in the finalising of amendments to regulations governing the processes and procedures associated with individual ECS and individual ECNS licences. The regulator is specifically considering what it means to have control over a licensee and is proposing that the definition in the Competition Act be utilised when determining whether a transaction involving a licensee amounts to a change of control over that licensee.

[23 August 2022] ICASA will be holding public hearings in respect of submissions received on the Draft Amendment Regulations on the Processes and Procedures for Individual Licences 2022. [27 March 2022] ICASA has published draft regulations intended to amend the “Regulations on the Processes and Procedures in respevct of Applications, Amendments, Renewals, Surrender and Transfer of Individual Licences and Applications for Special Temporary Authorisations” for comment.

[13 March 2022] On 31 January 2022 ICASA published drafts amendments to the Class Licensing Processes and Procedures Regulations for comment.
Due to a fault with the government printer’s the relevant gazette was not made public until after the closing date for submissions – 28 February 2022 – had passed.
The purpose of the amendment is to introduce an additional requirement for those registering with ICASA for a licence exemption for the resale of electronic communications services, viz. the registrant must provide a copy of “the signed commercial agreement or lease entered into between the registrant and ECS or ECNS licensee (not applicable to private electronic communications networks)”.

Of interest is the proposed amendment to the Individual Licence Process and Procedure Regulations to include a process for an applicant to apply for the transfer of control of a service licence, an amendment required by the Electronic Communications Amendment Act 1 of 2014. This is the process which should have been in place for use by Vodacom and Neotel when applying for ICASA’s approval for a transfer of control over Neotel’s IECS and IECNS licences,
