[23 September 2015] ICASA has published a new form to be used to obtain information when it is conducting an inquiry under section 4B of the ICASA Act.
Inquiry Prescribed Form Regulations 2015
Section 4C of the same Act sets out the powers ICASA has to “require from any person such particulars and information as may be reasonably necessary” and to require a person to appear before at a specified date and time to make a statement and submit all relevant documents or objects in their possession, custody or control which are relevant to the inquiry.
The Regulations came into force on publication on 21 September 2015.
The information asymmetry between industry and the communications regulator is well-established and it is to be hoped that ICASA will in future use these provisions to ensure that it has the information required for efficient regulation.
